Pleadings in the great Wagner case were again commenced yesterday,
in the Court of Queen's Bench, by the counsel for Mr. Gye in support of the demurrer to Mr. Lumley's declaration. Mr. Lumley seeks damages from Mr. Gye, for enticing away the lady. The legal point now at issue is, whether an action can be sustained against any person who persuades ano- ther to break a contract, or whether the remedy in law is not confined to a proceeding against the person who broke the contract. The arguments were unfinished yesterday.
Mr. Macbeath, one of the persons whose names were used in the letters circulated by Lord Frankfort, obtained a verdict of 2001. damages against his Lordship for libel, in the Court of Queen's Bench, today. His counsel was instructed to offer the fullest apology.
